Privacy Policy

We know what you’re thinking – aw heck no, not more GDPR guff. Well buckle up buttercup, you’re in for the thrill of your life…

The short version – if you can’t bear to read any further (and let’s be honest, who has the time), then please know that we will do our best to always treat your details and personal information with respect and to use our common sense when doing so. We’ll also try our hardest not to make like an MI5 agent and leave our laptops lying around on a train or other public place. Pretty sure that our name just went on a list somewhere for saying that (wait, they’re not allowed to do that, are they? – GDPR win!).

WHO ARE WE

We are Jay & Christina Golian, aka Elemental Photography. You can read more about us over on the Who We Are page.

THE PHOTOS WE SHARE

So that’s our story. But the story that we’d really love to tell is yours.

If you’ve seen our photos or spent a little time browsing here then you’ll know that we’re all about catching moments and capturing the atmosphere and emotion of the day. And we’d like to say a massive thank you to all of our couples who agreed to have their story shared here on our website or over on social. If it wasn’t for their willingness to share their photos, then we’d have nothing to show you. Which would make it pretty tough to market ourselves as photographers!

Equally, if you’re a private kind of person (or if you’re planning a top secret elopement!) and would like to keep your wedding day offline, we’re absolutely down with that too. This is why we’ll check your preferences and get your consent to share before hitting the magic publish button. And if you change your mind in the future and want to share the love/no longer want to share your day with the internet world, then that’s absolutely cool too. Just drop us an email (info@elementalphoto.co.uk) and we’ll get on it just as soon as we can (and definitely within 20 business days, as sadly none of our overseas trips ever last that long).

Please note that we cannot be responsible for photos continuing to appear on third party sites such as Google images and Pinterest – but then you already know that, that’s just how the internet works. Hell, you probably know more about this stuff than we do! We’re just two folks trying to make a living doing what we love, buy our kid some Lego and see a bit of the world when we can.

HOW? WHAT? WHY? – THE INFO WE COLLECT FROM YOU

It probably comes as no surprise that if you fill out our contact form (and we are really hoping you will because we would love to hear all about your wedding plans!), then we will use the data you provide us with (in a non evil genius way) to check our availability for your date and get back to you with more details about our photography services. And if we’re unavailable for your date, we hope you don’t mind that we’ll check if any of the other kick ass photographers that we know are free that day (without sharing your name, contact details or other private information with them) and then we’ll let you know how to get in touch with them if they are. Because being helpful = good karma.

We’re not fans of interrupting your life with unnecessary phone calls or spamming folks over email, so please be assured that when we get in touch it will always be for a good reason. Like to let you know that your photos are ready. Or that Vogue called and they want you on the cover (because, you never know…).

But if you’re more of a talker than a typer/texter, then we’d love to schedule a time to chat with you. We’ve even conquered our fear of video chat and love nothing more than a good Skype these days.

The personal information we collect might include your name, address, email address, IP address, and information regarding what pages are accessed and when. If you purchase a product from us then your card information is not held by us, it is collected by our third-party payment processors, who specialise in the secure online capture and processing of credit/debit card transactions (definitely not our forte, we’ll stick to the photo taking!).

PIXIES V PIXELS

Not only do our cameras have pixels (although Christina prefers to think of them as pixies, so as not to kill the magic), so too does Facebook. And when we’re working on our digital marketing, we may indeed use that pixel on our website. Which means that an advert about us could appear on your Facebook feed. There is no serendipity on the internet. We’re guessing that didn’t come as a shock though.

COOKIES

Like many other websites, the Elemental Photography website uses cookies (Wikipedia has a beautiful description if you feel like you’d love to know more about them).

Cookies collect statistical data about your browsing actions and patterns and do not identify you as an individual. For example, we could use cookies to store your country preference and deliver a better, more personalised service (note to self, let’s do that).

It is possible to switch off cookies by setting your browser preferences. For more information on how to switch off cookies on your computer, Google “How do I switch off cookies on my computer?”. The flip side though is that turning cookies off may result in a loss of functionality when using our website.

MAIN COOKIES USED ON OUR SITE

Google Analytics

These cookies are used to collect information about how visitors use our site. We use the information to compile reports which we love to analyse every second Tuesday (this may not be strictly accurate) and to help us improve the site. The cookies collect information anonymously. This includes: the number of visitors to the site, where visitors have come to the site from (you get bonus points if you’re viewing it from Transylvania!), and the pages they visited.

For more information on Google Analytic’s privacy policy (it really is a riveting read) visit here – http://www.google.com/analytics/learn/privacy.html

Embedded/external Media

(This includes video, images and share buttons). Our website may include content embedded from external sites. When visiting pages with content embedded from YouTube, Instagram, Facebook and others you may be presented with cookies from these websites. We have no control over these cookies and we suggest that you check the information available on the relevant websites if you wish to learn more.

WHO WILL WE SELL YOUR DATA TO?

No-one. Nor will we share your details with third parties for marketing purposes. Because we are not dicks. Next question!

Third party service providers (there’s no denying it, this section is very dull – you can probably tell we were just gagging to break open the Kraken by this point!)

We may pass your information to our third-party service providers, agents, subcontractors and other associated organisations for the purposes of completing tasks and providing services to you on our behalf (for example to process payments and send you related emails).

However, when we use third-party service providers, we disclose only the personal information that is necessary to deliver the service and we have a contract in place that requires them to keep your information secure and not to use it for their own direct marketing purposes. Please be reassured that we will not release your information to third parties beyond the company for them to use for their own direct marketing purposes, unless you have requested us to do so, or we are required to do so by law, for example, by a court order or for the purposes of prevention of fraud or other crime.

When you are using our secure store pages, your payments are processed by a third-party payment processor, who specialises in the secure online capture and processing of credit/debit card transactions. If you have any questions regarding secure transactions, please shout.

We may transfer your personal information to a third party as part of a sale of some or all of our business and assets to any third party or as part of any business restructuring or reorganisation (for example, if Elon Musk calls and he wants to make us a very good offer!), or if we’re under a duty to disclose or share your personal data in order to comply with any legal obligation or to enforce or apply our terms of use or to protect the rights, property or safety of our supporters and customers. However, we will take steps with the aim of ensuring that your privacy rights continue to be protected.

HOW YOU CAN ACCESS AND UPDATE YOUR INFORMATION

Moved house or got a new phone number? That would be super helpful for us to know. Pop us an email on info@elementalphoto.co.uk to keep us posted on your news.

Or in GDPR talk – The accuracy of your information is important to us. You have the right to request a copy of the information we hold about you. You can do this by sending an email to info@elementalphoto.co.uk and requesting the information held about you.

RIGHT TO ERASURE

Want to make like a phantom and be gone? Send an email to info@elementalphoto.co.uk and we’ll get right on it.

SECURITY PRECAUTIONS TO PREVENT DATA LOSS/MISUSE

When you give us personal information, we take steps to ensure that it’s treated securely. Any sensitive information (such as credit or debit card details) is encrypted and protected by our third party payment processor.

Non-sensitive details (your email address etc.) are transmitted normally over the Internet, and this can never be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information you transmit to us, and you do so at your own risk. Once we receive your information, we make our best effort to ensure its security on our systems. Where we have given (or where you have chosen) a password which enables you to access certain parts of our websites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. Even if they offer you a really delicious looking doughnut with an Espresso Martini on the side in exchange, just say no.

LINKS TO OTHER WEBSITES

Our website may contain links to other websites run by other folks/organisations (because we like to share the love). This privacy policy applies only to our website‚ so we encourage you to read the privacy statements on the other websites you visit (especially if you’re having trouble sleeping). We cannot be responsible for the privacy policies and practices of other sites even if you access them using links from our website.

In addition, if you linked to our website from a third-party site, we cannot be responsible for the privacy policies and practices of the owners and operators of that third-party site and recommend that you check the policy of that third-party site. Or not – the choice is yours!

16 OR UNDER

Lucky you – the world is your oyster! Chances are you’re not quite ready to tie the knot, but if you’re thinking of getting in touch then please get your parent/guardian’s permission beforehand whenever you provide us with personal information.

TRANSFERRING YOUR INFO OUTSIDE OF EUROPE

As part of the services offered to you through this website, the information which you provide to us may be transferred to countries outside the European Union (“EU”) – which, sadly, will include us soon. By way of example, this may happen if any of our servers are from time to time located in a country outside of the EU. These countries may not have similar data protection laws to the UK. By submitting your personal data, you’re agreeing to this transfer, storing or processing. If we transfer your information outside of the EU in this way, we will take steps to ensure that appropriate security measures are taken with the aim of ensuring that your privacy rights continue to be protected as outlined in this Policy.

If you use our services while you are outside the EU, your information may be transferred outside the EU in order to provide you with those services.

THE END (YOU’LL BE RELIEVED TO HEAR)

Huge high five to you if you made it this far!

We may change this policy from time to time (we like to switch things up, it keeps life interesting) so please check this page occasionally to ensure that you’re happy with any changes. By using our website, you’re agreeing to be bound by this policy.

Any questions regarding this policy and our privacy practices should be sent by email to info@elementalphoto.co.uk.

We keep this policy under regular review (just like those analytics reports we’re so fond of spending time on). This policy was last updated in November 2018.

Now pour yourself a drink and enjoy the photos. You’ve earned it!
